Wills, Trusts, & Probate
Digital Wills and Wills in hardcopy.
Anyone with a smart phone can make a digital recording and call it a digital will. Digital wills, appear to be easy to make but can be expensive and difficult to prove.
If you want to make Digital will, speak with our office first and we’ll advise you on how to do it. We are available to take your call.
Do you need a will?
A will is a testamentary instrument which you draft for family and friends to assist them to administer your estate which means to distribute your estate to the beneficiaries named in your will.
Most people need a will because they own some property be it land, shares or money in the bank. Generally, if you own property, your will must be presented as evidence in the Court before your executor can administer your estate ie give it to your beneficiaries. If you make a digital will your phone or storage device may have to be produced to the court, its contents and metadata examined and proved. This can be both complex and costly.
Digital Assets and Digital wills – two different things.
Digital assets you own should be gifted in your will, but leaving a digital will itself, adds an additional layer of complexity (therefore time and money) to the administration of your estate – especially if your phone or device is secured by a password.
Regardless of the above, if you want to make a digital will, before you do so, get reliable legal advice on how to make it, verify it and store it.
